The radical views of lesbian gay activist Chai Feldblum, recently appointed to the Equal Employment Opportunity Commission (EEOC) may lead to the trampling of religious liberties if Congress passes the Employment Non-Discrimination Act (ENDA) – a bill she helped to draft.
The American Family Association (AFA) is warning that the recess appointment of Chai Feldblum, combined with the passage of the controversial ENDA, may usher in a new era for American employers who will be forced to hire homosexuals and transvestites or face crippling lawsuits.
Feldblum, a Georgetown University law professor, was instrumental in drafting and negotiating the Americans with Disabilities Act of 1990 as well as ENDA and various medical privacy bills and regulations.
In 2006, she signed a statement, “Beyond Same-Sex Marriage,” which is considered to be the most radical assault on marriage and the family ever written. This statement maintains that every conceivable “partnership” and “relationship” should be on a par with marriage, and even went so far as to say that “Queer couples who decide to jointly create and raise a child with another queer person or couple, in two households,” should be given governmental and private recognition.
Concern over these radical views caused her nomination to stall in the Senate, but the President was able to side-step this roadblock through the use of a recess appointment. Even though her appointment will last only as long as the next session of Congress, the fact that someone with these views will be sitting on the EEOC, an agency charged with enforcing federal anti-discrimination laws, could cause innumerable problems in the workplace.
For instance, Feldblun once addressed a scenario in which an evangelical Christian couple may not want to rent facilities to couples who intend to indulge in sexual immorality, adultery or sodomy on their premises in this way: “[T]his is a point where I believe the ‘zero sum’ nature of the game inevitably comes into play. And, in making the decision in this zero sum game, I am convinced society should come down on the side of protecting the liberty of LGBT people.”
“In other words, gays win, Christians lose. Every time,” said AFA president Tim Wildmon.
Feldblum’s appointment is even more worrisome because President Obama, House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid are planning to force a vote on ENDA.
Should the bill pass, “Values-driven employers who happen to be Christians will be forced to hire male employees who want to wear dresses to work and use the women’s restroom or face crippling lawsuits,” Wildmon says. “Employees who express reservations about homosexual conduct will find themselves out of a job.”
And because “sexual orientation” is not defined in the bill, “it will give special legal protections to 30 sexual orientations listed by the American Psychiatric Association, including pedophilia, prostitution, bestiality and cross-dressing, to name just a few,” he said.
But ENDA can be stopped. The bill has been introduced in almost every Congress since 1994, but was never able to pass, even after Democrats gained majorities in both houses in 2006. Openly homosexual representative Barney Frank recently reintroduced the bill, which has the President’s support, and a vote may be coming soon.
