The parents of a six-year-old girl attending Santa Fe Public Schools has been ordered by a school counselor to send their daughter to reeducation “counseling” after she complained about a gender-confused boy who was exposing himself in class.According to lawyers at Liberty Counsel, a national non-profit litigation, education, and public policy organization, the problem started for six-year-old Molly McGavin (not her real name) when a biological male classmate who identified as a female began exposing himself in class, inappropriately touching the girls, and using the girls’ bathroom. When Molly told her parents about this behavior, they immediately contacted the school. But instead of agreeing to address the problem with the male student, they insisted that Molly was the problem because she refused to accept the boy’s transgender identity. The school counselor then told the parents that Molly would have to be sent to counseling so that she could become more understanding and accepting of transgender students.
Liberty Counsel learned that the same school counselor also oversees the enter school district’s “gender support” program which enables this counselor – who is not a doctor or psychologist – to decide whether to socially transition children at school without their parents’ knowledge.
As Liberty Counsel founder Matt Staver writes in an email alert, “If the counselor concludes that a ‘transition’ is necessary for the benefit of the gender-confused child, she will hold meetings with administrators, teachers, and counselors to ‘socially transition’ the child at school, including, at a minimum, name, gender marker, and pronoun changes, as well as access to restrooms and locker rooms that align with the child’s perceived or claimed gender identity.”
The parents refused to go along with this outrageous program and withdrew their child from the school.
Liberty Counsel then filed a formal complaint with the U.S. Department of Education’s Office of Civil Rights (OCR) against Santa Fe Public Schools (SFPS) on behalf of the parents, citing the district’s policies that normalized sexual misconduct from a gender-confused male student. The complaint states that these policies allowing students to “identify” as a different gender and access opposite sex facilities amounts to sex discrimination against females and violates Title IX, students’ civil rights, and parental constitutional rights.
The filing requests the OCR open an investigation into SFPS, review their gender identity policies and take corrective action aligned under federal law and constitutional precedent to eliminate this discriminatory and harassing environment.
“SFPS’ secret transitioning, renaming, and re-sexing of children without meaningful parental consent violates clearly established parental rights caselaw extending back more than 100 years,” reads the complaint.
Liberty Counsel also sent a detailed demand letter to SFPS requesting it protect all students by disciplining students engaging in sexual misconduct, eliminating its policies that encourage gender “transitions” and secrecy, and reinstating sex-based privacy restrictions for restrooms and locker rooms. However, SFPS declined to change its policies.
“The deliberate indifference by Santa Fe Public Schools toward sexual misconduct and the safety and wellbeing of female students violates Title IX and ignores morality and biological reality,” said Staver. “A federal investigation is the next step toward correcting these unlawful actions to protect students. Parents should not have to withdraw a child from school over gender policies that violate federal law, endanger children, and usurp parental rights. SFPS should eliminate these policies immediately to protect children.”
Too many children are being left hurt and confused by the transgender madness that is infesting our public schools. Let us pray that the courts will put a stop to it and our children will find the healing they need.
