In the past two weeks, legal moves by the abortion lobby are revealing the industry’s desperation to hang on to Medicaid funding that was stripped from abortion facilities in the One Big Beautiful Bill, but how successful will their efforts be?On July 28, U.S. District Judge Indira Talwani in Boston ruled that Planned Parenthood clinics nationwide must continue to be reimbursed for Medicaid funding. The move will indefinitely block a provision in the One Big Beautiful Bill that would strip funding for one year.
“Although it was not named in the provision, Planned Parenthood, the nation’s largest abortion provider, sued in response, arguing the parameters for ending these funds effectively singled it out,” the Detroit Catholic reports.
Talwani wrote in the order, “Patients are likely to suffer adverse health consequences where care is disrupted or unavailable.”
The U.S. Department of Health and Human Services (HHS) criticized the ruling.
“We strongly disagree with the court’s decision,” HHS spokesman Andrew Nixon said. “States should not be forced to fund organizations that have chosen political advocacy over patient care. This ruling undermines state flexibility and disregards longstanding concerns about accountability.”
The Trump Administration plans to appeal the ruling.
Meanwhile, Democratic attorneys general from 22 states along with Pennsylvania Gov. Josh Shapiro filed a lawsuit that seeks to block the provision that would stop Medicaid funding to abortion facilities.
Marjorie Dannenfelser, president of America’s leading political pro-life group, Susan B. Anthony Pro-Life America, blasted the Democrats in a statement:
“This assault on democracy shows just how extreme the Democrats have become on abortion. The party of safe, legal and rare is now the party of forcing taxpayers to prop up Big Abortion’s death facilities with their hard-earned money. This bill was passed by our elected representatives and signed by President Trump. Yet, rather than respect the democratic process, Democrats are once again running to activist judges to impose lawfare on Americans with their extreme abortion agenda. They will not prevail.”
According to The Washington Times, both lawsuits were filed in the same court: the U.S. District Court for the District of Massachusetts. As a result, it’s possible that Judge Talwani, the same judge who issued the injunction, could also hear the Democratic attorneys’ general challenge to the defunding provision.
“Let’s be clear: this lawfare is about protecting Big Abortion’s bottom line and the campaign contributions Democrats rake in from Planned Parenthood,” Dannenfelser continued.
“In 2024, Planned Parenthood spent almost $70 million trying to elect Democrats and impose woke policies. In turn, these same Democrats push extreme abortion agendas that hurt women and end the lives of over 1.1 million unborn children each year. Gov. Shapiro presides over a state where abortion complications have tripled and half of the state’s facilities flunk basic health inspections. AGs like Letitia James (NY), Rob Bonta (CA) and Matthew Platkin (NJ) have tried to increase the number of abortions sold in their states by shutting down pregnancy centers that provide real help to women in need.”
She added: “Americans are watching and this disgraceful campaign to protect the abortion industry at all costs will not stand.”
