Opposition Mounts As Kagan Vote Nears

With a Senate vote that may confirm U.S. Solicitor General Elena Kagan to the Supreme Court only days away, her controversial involvement in the partial birth abortion debate and other political activism has made her the most opposed nominee in recent history.

According to a new Gallup poll, only 44 percent of Americans support her nomination, making her the least popular among recent Supreme Court nominees.

“If confirmed, Kagan would be the first successful nominee in recent years whose nomination was backed by less than a majority of Americans in the final poll before the Senate confirmation vote,” the polling firm noted.

According to Gallup, more Americans backed pro-abortion Sonia Sotomayor (55%), Samuel Alito (54%), John Roberts (60%),  Ruth Bader Ginsburg (50%), and Clarence Thomas (58%).

Ms. Kagan has also garnered stern criticism from former surgeon general C. Everett Koop said in a letter delivered yesterday to members of the Senate that her involvement in fudging statements from medical associations to make them show support for partial birth abortion was “unethical” and “disgraceful.”

“She was willing to replace a medical statement with a political statement that was not supported by any existing medical data,” writes Koop.

Charmaine Yoest, head of the pro-life group Americans United for Life, told the paper her group will be on Capitol Hill today to draw attention to Koop’s letter and to raise concerns about Kagan’s “apparent willingness to distort the record” in order to obtain “the political outcome she wanted.”

Yesterday, senators also received a petition opposing the Kagan nomination from Students for Life of America (SFLA) and LifeNews.com which contained nearly 8,000 signatures. 

“America does not need another activist justice on the Supreme Court, but rather one who respects the Constitution and individual rights, including those of the pre-born,” SFLA director Kristan Hawkins told LifeNews. “Confirming Kagan could mean 30 more years of legalized abortion in the United States even though a majority of Americans are now pro-life.”

SFLA and LifeNews.com created and promoted http://www.iopposekagan.com , an online petition opposing Kagan’s confirmation because of her radical support of abortion.

The Senate Judiciary Committee is scheduled to vote today on sending President Obama’s second Supreme Court nominee to the Senate floor for a confirmation vote. The vote was previously scheduled for last week but was blocked by pro-life members of the Committee in protest of her nomination. The full senate vote is expected to take place sometime before the August recess.
