Trump Admin Expected to Rescind “Bathroom” Directive Today

bathroom signsVarious media sources are reporting that the Trump administration is planning an announcement later today in which they will formally rescind former President Barack Obama’s controversial “Dear Colleague” letter which directed schools to allow students to use the facilities that correspond to their gender identity rather than their biological sex.

The Washington Post is reporting on a two-page draft of the new directive, issued jointly by the Department of Education and the Department of Justice, that is expected to be handed down sometime today.

“This interpretation has given rise to significant litigation,” the draft states. It goes on to say that school administrators as well as parents and students “struggled to understand and apply the statements of policy” in the guidance.

As a result, the departments “have decided to withdraw and rescind the above-referenced guidance documents in order to further consider the legal issues involved.”

However, the letter directs schools to continue to protect all students and specifically states that the withdrawal of the guidance “does not diminish the protections from bullying and harassment that are available to all students. Schools must ensure that transgender students, like all students, are able to learn in a safe environment.”

The Post called the reversal “a significant setback for the gay rights movement, which made enormous gains under President Barack Obama” and suggests that “President Trump, who had signaled during the campaign and in the early days of his presidency that he supports gay and transgender rights, will hew closer to the GOP party line.”
