The court battle continues this week for the free speech rights of David Daleiden, the man responsible for producing undercover videos that exposed the abortion industry’s peddling of aborted fetal body parts.

According to the Life Legal Defense Foundation (LLDF), which is representing Daleiden and the Center for Medical Progress (CMP), attorneys are heading back to San Francisco Northern Federal District Court of California on December 18 in what has become a protracted legal battle to defend Daleiden against a lawsuit filed by the National Abortion Federation (NAF).

The suit seeks to secure a Preliminary Injunction gag-order to silence the CMP from publishing the evidence of criminal activity between NAF and Planned Parenthood and to censor the video evidence already released.

The NAF is so desperate to stop the publication of this evidence, that they have accused Daleiden of obtaining the videos illegally by sneaking into “top secret” annual meetings.

The evidence, however, proves otherwise.

In a declaration filed last week, Daleiden exposes the lie with video-taped meetings between representatives of a fictitious procurement company named BioMax Procurement Services LLC which became popular in the abortion industry for promising to pay more for fetal body parts than competitors. Daleiden’s tapes proved that he did not “sneak” into any secret meetings but was personally invited to attend and given the exact date, time and location of the meeting by NAF employees.

“NAF unwittingly rolled out the red carpet for BioMax because NAF believed they were illegal dealers in fetal tissue,” said Catherine Short, LLDF’s vice president and Daleiden’s lead counsel. “It’s time for the National Abortion Federation to admit the truth: they were completely taken in by a legitimate undercover investigation, and yes, they were uncovered.”

CMP’s Opposition filing clearly states that the “NAF has spun this investigative journalistic endeavor into an eleven-count complaint containing allegations ranging from racketeering and fraud to trespass. Despite months of rhetoric about CMP’s putative ‘fraud’ and ‘crime spree,’ however, for its preliminary injunction motion, NAF relies on only two claims: breach of contract and violation of California Penal Code § 632.”

The LLDF correctly states that Daleiden’s videos and related information about the unethical practices of the nation’s largest abortion provider serve an important public interest.

“Planned Parenthood operates more than 700 clinics across the U.S. and almost half of its annual revenue comes from tax dollars,” the LLDF writes. “Americans have a right to know what kind of organization is spending their hard-earned money.”

Daleiden is standing firm in is conviction that "The National Abortion Federation is a criminal enterprise and a key partner in Planned Parenthood’s late-term abortion and baby body parts business."
